Terms of Service

These Terms of Service ("Terms") are an agreement between you and RoushTech, LLC ("Raptify", "we", "us") governing your use of the Raptify website, app, and monitoring service. By installing the app, creating an account, or using Raptify, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

If you use Raptify on behalf of a business, you confirm that you have authority to bind that business to these Terms.

What Raptify provides

Raptify is a web performance monitoring tool. It runs scheduled synthetic tests against the URLs you choose and reports measurements such as load timings, Core Web Vitals, scores, uptime, and related diagnostics. These measurements are informational estimates, not guarantees. Synthetic results depend on test conditions and third-party tooling, may differ from what your real visitors experience, and are not a guarantee of search ranking, conversion, revenue, or any other outcome. You are responsible for the changes you make based on them.

Eligibility

Raptify is intended for business use. You must be at least 18 years old and able to form a binding contract to use it.

Your account

You are responsible for keeping your login credentials secure and for activity under your account, including any Shopify connection you authorize. Tell us promptly at support@roushtech.net if you suspect unauthorized use.

Authorized monitoring only

You may only configure Raptify to monitor websites and URLs that you own or are otherwise authorized to monitor. You must not use Raptify to test, probe, overload, or attack any property without authorization. Monitoring is governed by our Acceptable Use Policy, which is part of these Terms.

Your content and data

You keep ownership of the data you provide, including your monitoring configuration and the targets you choose. You grant us a non-exclusive, worldwide license to host, store, process, and display that data and the resulting test results only as needed to operate the service for you.

You are responsible for the targets and content you submit, and you represent that you have the right to have them monitored by Raptify.

Acceptable use

Do not misuse the service. In particular, do not: break the law; monitor or attack properties you are not authorized to; attempt to access accounts or data that are not yours; probe, scan, or disrupt the service or its infrastructure; scrape or harvest data at scale; resell or redistribute the service; or interfere with other users. See the Acceptable Use Policy for details.

Subscriptions, trials, and billing

Some features require a paid subscription. The current price and any free-trial terms are shown at the time of purchase.

  • Billing. For Shopify merchants, subscriptions are sold and billed through Shopify Billing under Shopify's terms, and charges appear on your Shopify invoice. For direct customers, subscriptions are billed through Stripe using the payment method you provide.
  • Free trial. If a free trial is offered, you will not be charged during the trial. Unless you cancel before the trial ends, it converts to a paid subscription automatically.
  • Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel before the end of the current period.
  • Cancellation. You can cancel anytime in your Shopify account (Shopify merchants) or in your Raptify billing settings (direct customers). Cancellation stops future renewals; you keep access until the end of the period you already paid for.
  • Refunds. Refunds for Shopify-billed subscriptions follow Shopify's policies. For direct subscriptions, we may offer refunds at our discretion, but we are not obligated to beyond what applicable law requires.
  • Price changes. We may change subscription prices. Changes apply to future billing periods, and we will give notice as required by the relevant store and applicable law.
  • Complimentary access. We may grant free or discounted access at our discretion, and we may end it at any time.

Intellectual property

Raptify, including its software, design, logos, and brand, is owned by RoushTech, LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding. We grant you a limited, revocable, non-transferable license to use the service under these Terms.

Service availability

We work to keep Raptify available and reliable, but we provide it on an "as available" basis. We may change, suspend, or discontinue features, and we may limit availability or perform maintenance. Monitoring may be delayed or missed during outages, maintenance, or upstream provider failures.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that measurements are accurate, that alerts will always be delivered, or that the service will be uninterrupted or error-free. Diagnostics rely in part on third-party tooling and may be incomplete or incorrect.

Limitation of liability

To the fullest extent permitted by law, RoushTech, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising from your use of the service, including any reliance on a measurement or any missed or delayed alert. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or twenty-five US dollars (US $25). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless RoushTech, LLC from claims arising out of your misuse of the service, your monitoring of properties you were not authorized to monitor, or your violation of these Terms or of any law or third-party right.

Termination

You may stop using Raptify, uninstall the app, and close your account at any time. We may suspend or terminate your access if you violate these Terms or use the service in a way that risks harm to others or to the service. On termination, the provisions that by their nature should survive will survive.

Governing law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Hamilton County, Tennessee for disputes that are not otherwise subject to a binding alternative process.

Changes to these Terms

We may update these Terms as the service evolves. We will revise the "Last updated" date and, for material changes, provide more prominent notice. Continuing to use Raptify after changes take effect means you accept them.
